The Divorce Process
 
Going through a divorce is difficult in any situation, but it is made even tougher because it requires spouses to go through the legal process of obtaining a divorce.  Fortunately, family law in Virginia is well-established and  the court system has a straightforward process through which parties can obtain a divorce.
 
Particularly when parties are in agreement as to major issues in the case such as spousal support , child support and custody and the division of property , the legal aspect of the divorce process can be quick and painless.  When parties are not in agreement on some of these issues, the process may be more contentious.  In either case, an attorney can assist you as you work toward resolution of these matters with your spouse either by settlement or in court.
 
No matter what issues there are in your case, you will be able to obtain a divorce by filing a Complaint in a Virginia Circuit Court and statting one of the statutory grounds for divorce.  The process will differ depending on whether you are pursuing an uncontested divorce or a contested divorce , so plan accordingly.
